The 2020 Trademark Modernization Act created a process to help clear up deadwood on the trademark registry: expungement and reexamination proceedings. Because they require evidence that a mark was not being used, these proceedings can seem daunting, but this panel is here to help. Tamara Rabenold, IP investigator & CEO of Vaudra International, will moderate a discussion between trademark attorneys Britt Anderson of Perkins Coie, Charis Dorsey of The Dorsey Firm, and Eric Perrott of Gerben Perrott. The panel will explain how and when to file these types of proceedings, discuss what a reasonable investigation involves, and provide tips and strategies to consider based on examples of initiated and rejected proceedings. Topics will include:
- When to file expungements and reexamination proceedings
- What to expect in terms of timelines and stages
- How to investigate and collect evidence
- What to submit and how to present a case
